Terms & Conditions of Sale (B2C) – Effective as of July 28, 2025

 These terms and conditions apply, without restriction or exception, between FLYROV, a micro-enterprise with registered office in SAINT-DENIS-LÈS-BOURG, France, and registered to the Chambre de Métiers et de l’Artisanat Auvergne-Rhône-Alpes under the SIREN number 948 878 731, hereinafter referred to as the “Company”, operator of the site vectorvario.com and seller of the products offered there, and any individual or legal entity wishing to make a purchase via vectorvario.com, hereinafter referred to as the “Buyer”. Placing an order on vectorvario.com implies full and unconditional acceptance of these terms and conditions by the Buyer.

1 - Purpose

These terms define the contractual relationship between the Company and the Buyer, as well as the conditions applicable to any purchase made via vectorvario.com by a consumer as defined by law—i.e. a natural person acting for non-professional purposes. By purchasing a product through this site, the Buyer acknowledges having read, understood, and unconditionally accepted these terms, which take precedence over any conflicting terms unless expressly accepted by the Company. Prior to any transaction, the Buyer declares they have full legal capacity or parental authorization to bind themselves under these terms and conditions. The Company reserves the right to modify these terms at any time. Accordingly, the terms in effect at the time of the order shall apply.

2 – Products

The products for sale are those displayed on vectorvario.com, subject to stock availability. The Company may adjust the product range at any time. Product descriptions and technical characteristics are provided in good faith, but photographs are for reference only and do not engage the Company. Sales are intended exclusively for Buyers residing in countries where the entry of these products into their territory is fully authorized.

3 – Pricing

Prices shown on product pages are in euros (€), inclusive of all taxes, including the applicable VAT rate on the date of the order. Any legal change in VAT rates will be automatically applied to product prices. The Company reserves the right to change prices at any time. However, the price charged to the Buyer will always be the one in effect when the order is validated. Unless otherwise stated, prices include order preparation and standard delivery costs. Free shipping is offered for all orders destined to France, EU countries, Andorra, Monaco, Switzerland, and the United Kingdom. For other destinations, shipping costs are calculated automatically when placing the order and added to the total amount payable at checkout.

The Buyer is responsible for any currency conversion in their country and any conversion fees charged by their payment provider, which are not covered by the Company. For deliveries outside the European Union, the Buyer is solely responsible for import formalities, customs duties, local taxes or any additional charges and must pay them directly to the relevant local authorities. The Buyer must ensure compliance with the destination country's import regulations. The Company is not liable for or required to inform the Buyer about applicable restrictions, duties, or taxes. The Buyer is strongly advised to consult their country's customs or tax authorities before placing an order.

4 - Order

To make a purchase, the Buyer must add desired items to the cart, verify selected items and quantities, fill in all required information for processing and delivery, select a shipping method if multiple options are offered, and finally confirm the order by clicking the “Pay” button.

Order confirmation signifies full and unconditional acceptance of these terms, acknowledgment of prior knowledge, and waiver of the Buyer's own terms. The data entered and the recorded order confirmation serve as proof of the transaction. All orders are subject to prior acceptance by the Company. The sales contract is only finalized upon written confirmation by the Company. The Company may refuse any order, in whole or in part, for legitimate reasons such as payment disputes or orders exceeding predefined limits. The Buyer will receive order confirmation by email.

Creating a customer account on vectorvario.com is optional but recommended. It allows the Buyer to track past orders, manage personal information, and simplify future purchases. Account creation requires a valid email address and a password chosen by the Buyer.

5 - Payment

The Company offers secure payment by credit card only. Payment is processed when the order is confirmed. Once payment is accepted, the order is recorded and the contract is binding. Credit card payments are final. The Buyer guarantees they are authorized to use the card for the transaction. To prevent fraud, the Company may request a copy of official ID and proof of address for any payment.

6 - Retention of Title

The Company retains full ownership of goods sold until full payment, including principal, fees, and taxes. This does not affect the transfer of risk to the Buyer, which occurs when products leave the Company’s premises.

7 - Delivery

The Company commits to dispatching goods within three business days, subject to stock availability. If stock is unavailable, the Buyer will be notified of estimated restock delays. If accepted, the order remains; otherwise, it will be canceled and refunded within 14 days. Delivery is made to the address provided at checkout, within the Company's delivery zones. The carrier choice depends on the delivery address. A tracking number is sent by email when the order ships. Delivery times are provided by the carrier and are indicative only. In case of force majeure or events beyond the Company's control affecting delivery, the Buyer will be informed and offered alternative options.

In the event of the Buyer’s absence at the time of delivery, a delivery notice will be left. It is the Buyer’s responsibility to collect the parcel or arrange a new delivery directly with the carrier. If the parcel is not collected within the specified timeframe, it will be returned to the Company, which may then issue a refund excluding shipping fees. If the order is not delivered within 30 days from the date of purchase, the Buyer may request the cancellation of the order and receive a full refund of the amounts paid. Transport-related risks are transferred to the Buyer as soon as the parcel is handed over to the carrier (i.e. when it leaves the Company’s premises). Delivery is deemed completed upon receipt of the parcel by the Buyer, as evidenced by the Buyer’s signature on the delivery slip or, failing that, by any distribution proof provided by the carrier, which shall serve as conclusive evidence. Upon delivery, the Buyer must check the condition of the parcel in the presence of the delivery person. Any anomaly (damaged, opened, or incomplete parcel, etc.) must be immediately reported with specific, dated, and signed reservations noted on the delivery slip, and subsequently confirmed by registered letter with acknowledgment of receipt sent to the carrier within three business days, with a copy sent to the Company.

If delivery does not occur within 30 days from the order date, the Buyer may request contract cancellation and full refund.

8 - Right of Withdrawal

In accordance with Article L221‑18 of the French Consumer Code, consumers have a 14‑business‑day cooling‑off period from the delivery date to cancel the purchase and return the goods for exchange or refund, excluding return shipping costs. Refunds will be issued within 30 days from notification of withdrawal to the billing address used.

9 – Warranty

All products benefit from the statutory warranty under Articles 1641 et seq. of the French Civil Code. Non‑conforming products may be returned for exchange, return, or refund. The Buyer must submit any claim, exchange request or refund via the contact form on vectorvario.com to obtain an authorization code. The Company reserves the right to charge shipping fees if the return is accepted.

The statutory warranty does not apply (or only partially applies) to damage caused by external events (accidents, shocks, water, heat, mold) or Buyer misuse (improper use, negligence, unauthorized modifications). Surface damage may not be covered. In that case, the Company may offer a repair estimate. Administrative fees may apply if the estimate is declined.

10 - Liability

The Company’s obligations are those of a best-effort nature. It cannot be held liable for damages caused by use of the Internet such as data loss, system intrusions, viruses, service interruptions, or other involuntary issues.

The Buyer acknowledges the responsibility to read the user manual posted on the website containing essential instructions, safety warnings, and alerts. The Company shall not be liable for damages resulting from non-compliant usage, unauthorized alterations, negligence, or misuse of the product. In no event shall the Company or its suppliers be liable for direct or indirect damages arising from use or inability to use the products. Liability is strictly limited to the amount paid for the product in question.

11 - Intellectual Property

All content on vectorvario.com remains the exclusive intellectual property of the Company. Reproduction, exploitation, or use of any portion of the site—images, logos, visuals or text—is prohibited without prior written permission.

12 - Data Rights & Data Deletion

The personal data you provide are essential for processing orders, shipping, invoicing, and handling warranties. Without them, orders cannot be completed. When registering, you commit to providing accurate and truthful information. Misrepresentation constitutes a breach of these terms and site usage rules. The Company ensures confidentiality of personal data collected via its e-commerce site or support service. Such data is never sold, shared or transmitted to third parties; use is strictly internal.

In accordance with the GDPR and the French “Informatique et Libertés” law (Law n°78‑17), you have the rights of access, rectification, erasure, objection, restriction, and portability concerning your personal data. You may exercise these rights at any time via the contact form at vectorvario.com. The Company commits to responding promptly and deleting your data unless retention is required by law.

13 – Dispute Resolution

Electronic records held by the Company are deemed valid proof of communications, orders, payments and transactions between the parties. These terms are governed by French law. If a dispute arises, the Buyer is encouraged to contact the Company via the web contact form for an amicable resolution. Under Articles L611-1 et seq. of the French Consumer Code, the Buyer may resort to a free consumer mediator. If no agreement is reached, disputes will be submitted to the competent French courts, specifically the Tribunal judiciaire de Bourg‑en‑Bresse, France, unless mandatory jurisdiction rules state otherwise.

14 - E‑Waste Recycling

For equipment not covered by decree 2005‑829 on electrical and electronic equipment (EEE), the waste holder is responsible for disposal. For equipment subject to the decree, pursuant to Articles 18 and 21 of the same decree, the Buyer accepts responsibility for arranging and financing collection, treatment, and valorization of EEE waste. These obligations must be transferred through the supply chain to the end-user. Non-compliance with these obligations may result in penalties under Article 25 of the decree.

16 – Governing Language

In the event of any inconsistency between this French version and any translation, only the French version shall prevail.
